Non-govt organisations reject new law proposed by ‘MOSAL’ – ‘Proposed amendments violate articles of Kuwait Constitution’

KUWAIT CITY, Dec 27: Several Non-government Organizations have completely rejected the proposed law prepared by the Ministry of Social Affairs and Labor (MOSAL) to reorganize the activities of non-profitable organizations expected to be discussed in the current parliamentary term.

A statement signed by 31 NGOs warned of risks nursed by the proposed amendments, affirming suspicion of various proposed amendments that violate some articles of the Kuwaiti Constitution.

The statement indicated that some amendments go against establishing the objectives of nonprofit organizations in general, which will restrain the role of non-governmental and voluntary work sectors, and infringe vested rights and limit the role of civil modernization.

In a joint meeting held on Dec 17, they refused allegations concerning the discussion of the proposed amendments, affirming “the amendments wiped out its civil and voluntary essence and strip off its vested right and the rights of the general assembly, giving it a pure governmental feature, against the objectives of its establishment”.

In the first government response, Undersecretary of the Ministry of Social Affairs and Labor Dr Matar Al-Mutairi said the bylaw is still a proposal, and so far no decisions have been made in that concern. It has yet to be referred to the parliament or even discussed by the cabinet, indicating the ministry will provide all non-profitable organizations with a copy of the proposal.
