KUWAIT CITY, May 5: The Court of Appeals, presided over by Judge Mut’eb Al-Ardhi, overturned the verdict of a lower court which sentenced an Egyptian in absentia to three years jail term with hard labor. The higher court then acquitted the Egyptian of possessing hashish and brain stimulants for personal consumption.

According to the arresting officer, the accused was asked to stop during a security check during which he failed to present valid documents for his vehicle. When the officer asked the suspect to present the documents, the narcotic substances fell from the latter’s pocket. This prompted the officer to refer the Egyptian to the concerned security unit.

Attorney Enaam Haidar, who represented the accused, requested the court to nullify the search and arrest procedures due to lack of legal merit, in addition to the fact that her client denied charges from the start of investigation. Haidar asserted her client was arrested without proper legal procedures and without any substantial evidence, so the court ordered the release of the accused due to the absence of incriminating evidence.

Student not guilty: The Criminal Court presided over by Judge Waleed Al-Kandari acquitted a student of Saad Al-Abdullah Academy for Security Sciences who was accused of molesting a freshman. The defense counsel Lawyer Dalal Al-Mulla stressed the lack of evidences against her client, insisting that the accusation against her client was malicious because of his good performance and his seriousness in the military training of the newcomer students. She urged the court to acquit her client.

Because this incident was widespread in social media, Ministry of Interior had dismissed the student from the academy. During a press conference, Lawyer Dalal Al-Mulla appreciated the court for its just verdict and urged the Minister of Interior Sheikh Mohammad Khalid Al-Hamad Al-Sabah to restore the student’s place in the military corps.

Aide still unknown: The Public Prosecutor has decided to refer the Iranian who is responsible for leaking the message sent by Kuwait’s (former) Minister of Oil Ali Al-Omair to his Saudi counterpart Ali Al-Naimi, to the Criminal Court, reports Al-Jaridah daily.

The Iranian has been charged with publishing secret documents about the economy, and broadcast false information harmful to the country. Sources in the Prosecution said the suspect fled the country following the discovery of his identity. It has been reported the suspect was using an illusory account on Twitter. The daily said the identity of the person in the oil sector who provided the Iranian with information could not be revealed.

Sources in the investigation revealed Al-Omair sent that message to the Chief Executive Officer of the Kuwait Petroleum Corporation, Nizar Al-Adsani, and the latter sent a copy to the chairman of the concerned oil company, who in turn sent it to his aides. However, the investigations did not reveal the identity of the first person who leaked the message.
