Heirs of Al-Raja’an ‘demand’ halt to real estate auction sale

KUWAIT CITY, Nov 16: At a time when attention is focused on the auction of the 42 properties belonging to the late Fahd Al-Raja’an in Kuwait, the court of urgent matters received a lawsuit from the heirs of Al-Raja’an, demanding to stop the auction and not to sell the property, reports Al-Qabas daily. The heirs of Al-Raja’an contend this property now belongs to them and that after the death of the accused the criminal case filed against the late accused holds no water and the property can neither be sold nor put to auction. Moreover, the heirs cited errors in the auction procedures, according to what they said in the lawsuit papers, reports a local Arabic daily.

The court decided to reserve the case for judgment next Sunday, one day before the scheduled date of the auction, which is supposed happen on Monday. Fahad Al Rajaan as well as his wife and children had their assets frozen in Kuwait due to criminal complaints alleging misconduct during his time as head of Public Institute for Social Security (PIFSS). He was wanted by Interpol and actively hid abroad and was on the run until his death recently.

However, former MP Abdullah Al- Kandari affirmed the financial claims resulting from the infringement of public money cannot be forfeited or revoked by death, stressing that the reservations and claims in the case of the Public Institution for Social Security (PIFSS) are continuing and are not revoked by the death of Fahd Al-Raja’an. Al-Kandari said, “Article 22 of the Public Funds Protection Law of 1993 confirmed that funds, compensation, and confiscations apply to heirs and legatees, and that the ruling to return those funds is enforceable for everyone.” Al-Kandari pointed out that Article 54 of the Anti- Corruption Law issued in 2016 confirmed that the death of the perpetrator does not absolve his heirs from claiming a refund, stressing the obligation of his heirs to return the sums and property with compensation.
