Company refusing to give release although completed 4 yrs

I am a engineer. My company terminated me from my services today (23-12-2017) and the last working day will be on 22-03-2018. But my residence is valid up to 02-02-2018 only. I already got the other job offer. I asked for a local release but my company refused to give me. I joined this company on 07-01-2014 on Visa 18. They recruited me from India. I have almost completed 4 years. Am I eligible for the local release? If yes, what should I do if my company refused to give me a local release? Kindly do the needful. Thank you.

Answer: The company is wrong in refusing to give you a release. Under the Labour Law you are bound to work for them for at least three years before qualifying to ask for a release as they brought you to Kuwait from your home country. You have therefore fulfilled your obligation towards the company by working for them for almost four years.

Hence, the company have no choice but to grant you a release especially that they terminated your appointment. Indeed, the company were duty-bound to offer you a release if they terminated your services before the completion of your 3-months mandatory service period. Go ahead therefore, and file a case against them at the Ministry of Social Affairs and Labour through the Labour Department in your area, if they remain recalcitrant in granting you the deserved release.
