‘MPs request contradicts conflict-of-interests law’

KUWAIT CITY, April 8: Amid raging arguments concerning constitutionality of the request of 20 lawmakers to present a petition over the case of multimillion-dinar deposits based on the conflict-of-interests law that was recently approved by the National Assembly, a source affirmed that the request contradicts the law in its current form. He explained that the law is yet to be published in the official gazette.

It is still under review at the Council of Ministers along with other laws. Consideration is being given to the constitutionality or the need for an amendment similar to other laws such as Kuwait Municipality Law, early retirement, exchange of interest, indemnity in the oil sector, and citizenship law among others that are yet to be implemented.

The source asserted that the government will not allow jumping over the Constitution. He explained that the unambiguous opinion of the Council of Ministers indicates that implementing the new law retroactively against anybody who may have committed a relevant crime when it was not operational is unconstitutional.

However, an official and final decision has not been taken; but it can be expected in the next meeting.  As per the intention of some lawmakers to rise against the government and His Highness the Prime Minister in case their request to submit petitions over the multimillion-dinar deposits is not accepted, the source said, “We respect the lawmakers. They should also respect the Constitution and cooperate with the division of powers among the authorities.

Majority in the National Assembly will ensure triumph of the Constitution and will not accept holding the government accountable in case of implementation”. He went on to say, “I clarify that the results of the initial meetings will affirm the matching of some of those laws to the Constitution.

However, some observations will be corrected and adjusted through an executive decree so that the laws are made capable of being enforced”.
