Minister calls for committee to ‘probe’ financial and administrative violations

KUWAIT CITY, Jan 5: The Minister of Social Affairs, Minister of Awqaf and Islamic Affairs Issa Al- Kandari has issued a ministerial decision detailing the mechanism and controls that must be adopted concerning accounts of societies and the cooperative societies union.

The first article of the decision, a copy of which has been obtained by the Al-Seyassah daily, states that the violations attributed to cooperative societies are investigated by a committee formed for this purpose based on a complaint submitted to the Ministry or a report submitted by one of the departments of the Cooperation Affairs Sector, and that the committee is formed by a decision of the assistant undersecretary of the ministry for cooperative societies affairs after the approval of the undersecretary based on a memorandum submitted to him that includes the reasons and justifications for the formation of the committee.

In the statement it must be mentioned whether the financial or administrative controller of the society or both took any measures regarding suspicions related to mismanagement or behavior by the board of directors of the association or any of those in charge of managing the association or its employees.

In the first article, the decision also stipulates that the committee undertakes to investigate and checks the work and accounts of the concerned institution, provided members of the committee legal experts, accountants and the committee must have at least five but not more than n seven, including the president.

The second article defines the procedures of the investigation committee so that it prepares the minutes of the meeting to start the work of the committee, determines the tasks and specializations of each member, and searches and investigates the complaint or the report on the violations attributed to the association in coordination with the administration, the concerned authorities and the cooperative societies observers by examining and reviewing the general budget of the association and all financial and all administrative documents, books and accounting records related to the activity of the association, as well as ensuring the integrity, suitability and the recognized accounting systems.

The same article also stipulates that the committee refers the initial report to the assistant undersecretary of the cooperatives sector for his review and invite members of the board of directors of the association for a meeting during which they are informed of the report and listen to their comments and give them time to study the report provided the time frame does not exceed three months.

The third article states, “Within a week of the end of its work, the head of the committee shall hand over to the assistant undersecretary for cooperative affairs sector the original report to take appropriate action. The fifth article specifies the period of work of the investigation committee as 60 days, and it may be extended for a similar period. The Undersecretary of the ministry may also extend the work of the committee for another similar period to complete its work.
