Dear Arab Times, In 2022, I booked four airline tickets through a travel agent here in Kuwait. However, the airline was subsequently grounded, and to this day, the travel agent has not refunded the payment, a substantial sum that has put a real strain on us. Despite countless attempts to claim our money, we’ve been met with silence and inaction. How can we finally get justice and recover what’s rightfully ours?

Booking tickets through a travel agent can be convenient and time-saving, especially for complex itineraries or multi-city trips. Agents offer expert advice, access to special deals, and can assist with changes or problems during travel. They may also provide package deals combining flights, hotels, and transfers at lower costs.

On the downside, agents may charge service fees, cause delays in refunds, and limit your control over bookings. Transparency can be an issue, and if the agent is unreliable, recovering money can be difficult.

Getting a refund for a ticket booked directly on an airline’s website is usually straightforward. Simply log in to your account, locate your booking, and follow the airline’s refund or cancellation process

However, if a travel agent refuses to issue a refund, here is a step-by-step guide to help you recover your money

1. Check Your Booking & Receipts
- Keep copies of your e-tickets, invoices, and payment receipts from the travel agent.
- Make sure you have proof that the tickets were issued and not refunded.

2. Contact the Travel Agent in Writing
- Send a formal written request (email or letter) asking for a refund.
- Clearly state the booking reference, passenger names, amount paid, and mention that the airline was grounded.
- Request a written reply with a deadline (e.g., 14 days).

This documentation is important if you escalate the case.

3. Approach the Directorate General of Civil Aviation (DGCA) Kuwait
- DGCA regulates airlines and agents in Kuwait.
- You can file a complaint with DGCA’s Consumer Protection Division.

4. File a Complaint with the Ministry of Commerce & Industry (MOCI)
- Travel agents are licensed under MOCI.
- You can file a complaint with the Consumer Protection Department if the agent refuses to refund.
They can summon the travel agent and push for a settlement.

5. Consider Legal Action if Needed
- If the amount is significant and neither DGCA nor MOCI resolves it, you can file a civil case in the Small Claims Court (Kuwait).
- Lawyers in Kuwait often handle such consumer disputes, especially if multiple passengers are involved.

Tip: Some passengers succeed faster when they also raise the issue publicly (e.g., social media tagging the airline/travel agent) while continuing the official complaint path.
