Man acquitted in drugs case – Trio jailed for forgery

KUWAIT CITY, Dec 9: The Criminal Court acquitted a Kuwaiti citizen who was accused of peddling in brain stimulants and hashish. The Public Prosecution had accused the suspect of possessing Tremadol pills and hashish for trafficking. According to the case file, investigations by the arresting officer had led him to the house of the suspect where he found the abovementioned drugs. When interrogated, the suspect confessed that he had received the drugs from an inmate in Central Prison with whom he has no link. During the court session, the defense counsel Lawyer Elaf Al- Saleh affirmed that her client had denied the charges from the start of the investigations. She stressed on the invalidation of the arrest warrant and the subsequent arrest and search procedures due to lack of seriousness.

Trio jailed: The Criminal Court presided over by Judge Abdullah Al- Othman sentenced two Kuwaiti citizens and a Saudi national to sevenyear imprisonment, obliging the latter to return KD 5,400 which he received from the state illegally. The court also ordered the three defendants to pay fine worth KD 500 each. The Public Prosecution had accused the three suspects of falsifying official documents and providing false information in order to obtain Kuwaiti citizenship illegally. The third suspect (Saudi citizen) was employed in the Kuwait Army on the basis of the Kuwaiti citizenship he obtained illegally and had received salaries, which are part of the public funds, fraudulently.

Comp for scribe: The Court of Cassation obligated Ministry of Interior to pay temporary compensation worth KD 5,001 to journalist Muhammad Sendan for violation of his rights by Special Forces officers during the operation in the diwaniya of MP Jama’an Al-Harbash in 2010. The defense counsel Lawyer Nawaf Sari said he will request the court to determine the final compensation soon, stressing that this is the first of the verdicts to be issued against Ministry of Interior concerning the period that witnessed public movement.

Appeal dismissed: The Consultation Chamber of the Constitutional Court presided over by Judge Yousef Al-Mutawa dismissed the appeal filed by the lawyers of the convicted members of the Abdali Cell, stressing that the article in the Constitution which was the basis of the accusation is against the principles of freedom of opinion and freedom of belief. The lawyers insisted that the text of that article, which criminalizes the act of joining societies, groups or organizations that aim at demolishing the basic systems of the state, is not clear, adding that the vagueness of the text puts the issue in the hands of the authority to decide on banning any group or society that is in violation of the Constitution. They said the law states that no penalty can be issued without a relevant law.

‘Thief, money not yours’: The Court of Cassation chaired by Judge Faisal Khuraibet established a new judicial principle in cases where a bank worker makes cash deposit into a customer’s account by mistake and the person withdraws the money, knowing well the sum does not belong to him/her. The judge deems the act as theft, according to Article 223/2017 of the penal code, and the culprit is liable to five years in prison. The judge explained that all aspects of criminal conduct would have been proven by the act since the suspect is fully aware that he is using money belonging to someone else, without consent of the rightful owner. This analogy was drawn in a judgment delivered by the judge when he presided over a similar case where a specific sum was deposited in error into the account of a Kuwaiti man.
