Leaving Kuwait for good before completing the contract period

I was recruited from India and have been working in Kuwait for the last one year. Since I have some problems back at home, I am planning to leave the country for good by the end of March. Is it possible I can leave if I submit my resignation by the beginning of January. Waiting for your reply.

Answer: Under the Labour Law, you are supposed to work three years for your employer before you can resign or ask for a release. To leave the country for good without completing the three years, will mean that you will not be respecting your contractual obligations and hence will give your employer the chance to seek compensation from you. To prevent this, you have to come to an understanding with your sponsor explaining to him the need for you to return to your country for good. If he says okay, good for you and you can present your resignation by January to take effect in March. On the otherhand, if your sponsor says ‘no’ to your resquest then you should be prepared to pay compensation or rescind your decision to quit before the expiry of three years.
