Kuwaiti woman granted position as prosecutor after court ruling

KUWAIT CITY, May 26: The Administrative Court obligated the Ministry of Justice and the Supreme Judicial Council to appoint a Kuwaiti woman, who is a law graduate, into the position of “Prosecutor class C” for the year 2023, after proving that she deserves it. According to the case file, Lawyer Jarrah Hamid Al-Sharika explained that his client is of Kuwaiti lineage and origin, and belongs to an ancient and reputable family. She holds a university degree from the Faculty of Law of Kuwait University with a major grade of (very good) for the year 2021/2022. She then applied for the position of Deputy Public Prosecutor – C after it was advertised.

On September 2, 2023, she took the tests set by the ministry for that position at the Institute of Judicial and Legal Studies. She passed all the tests with high competence, and she had submitted certificates of appreciation from various authorities. However, she was surprised to know that her application was not accepted, and some others were chosen to fill that job even though they were lower than her in terms of competence and excellence in academic degrees. Those whose applications were accepted held good and acceptable grades, while she obtained her university degree from the Faculty of Law at Kuwait University with a major grade of (very good).

On 11/12/2023, she filed a grievance and petitioned the administration’s decision to reject her despite her qualifications and achievements. She requested the administration to reconsider its decision, as it was marred with unfairness. However, the administration did not respond to her request, which prompted her to file a lawsuit. The complainant’s defense counsel Lawyer Jarrah Hameed Al-Sharika said the court ruled that the defendant be obligated to appoint her without ordering the cancellation of the appointment of any of those who were previously appointed. Attorney Al-Sharika said, “Since the lawsuit was filed, we believe that my client was entitled to this job due to her merits.
