Kuwait plans strict rules for influencer and celebrity ads

KUWAIT CITY, Sept 6: In a move to end the chaos in the field of celebrity and social media influencer advertisements, the Ministry of Information will soon adopt regulations for advertising on social media platforms under the new Media Law. Reliable sources told the newspaper that celebrities and social media influencers will be required to obtain licenses for individual advertising from the ministries of Information, Commerce and Industry to prevent fraudulent advertising on social media. Sources revealed that the new Media Law has two chapters on the advertising mechanism and the conditions for celebrities or social media influencers to obtain an advertising license.

Sources confirmed that the draft of the new Media Law is in its final stages at the Legal Advice and Legislation Department, and it is expected to be submitted to the Council of Ministers soon. Sources stated that the ministry has developed its vision for celebrity and corporate advertising, holding everyone accountable for their action, as per the regulatory, legal and commercial conditions without favoritism and without affecting consumer rights. Sources said the most important proposals include mandating the Ministry of Information to verify the social media accounts of influencers, celebrities and companies that provide advertising content. Sources affirmed the ministries of Information and Commerce and Industry are coordinating their efforts in this regard. “Those concerned will be given a certain period to regularize their status, and legal action will be taken against anyone who commits violations,” sources added.

Sources stressed the need for influencers, celebrities and companies to fully abide by the advertising regulations, such as ensuring that the advertised product or service is licensed. Sources cited as an example the medicines, which advertisers must ensure are licensed by the Ministry of Health. Similarly, the organizers of real estate exhibitions must obtain a license from the Ministry of Commerce and Industry before advertising, ensuring that the license is acquired through official channels. Sources said the advertisements of some celebrities or social media influencers resulted in court cases due to false and misleading contents, which made many consumers fall victim to fraud. Sources disclosed that the regulations cover visual, printed and written advertisements, indicating the Information Ministry has full authority to monitor advertisements, and in the event of violations, the case will be referred to the Public Prosecution.

Sources indicated that the methods for verifying celebrity and company accounts once the law is implemented are as follows:

- Submit an electronic account verification request to the Ministry of Information, including the account name and personal information.

- Sign a declaration and pledge to submit all documents and information related to the advertisement in accordance with the regulations on commercial advertising on social media.

Asked how celebrity or social media influencer accounts are identified, sources pointed out the influential social media accounts that advertise are clearly defined by measuring their reach and audience impact, indicating they will be covered by the new law.
