KUWAIT CITY, Sept 8: In implementation of Cabinet Resolution No. 67 on the amendment of the status of women whose Kuwaiti citizenship was revoked after acquiring it as per Article Eight of the Nationality Law, and Resolution No. 913, which preserves certain rights and benefits for individuals whose citizenship was revoked as per Article Five of the law (Noble Deeds Category), the Civil Service Commission (CSC) instructed ministries, departments and government agencies to adhere to the rules approved by the Civil Service Council for each category when signing contracts with those affected by the decision.
This includes disbursing a monthly bonus equivalent to the last salary received before the revocation of nationality, based on their job title and work location, in accordance with the contracts concluded with them.
This applies to those naturalized under Articles Eight (foreign wives of Kuwaitis) and Five (Noble Deeds Category), as well as those who obtained nationality through dependency.
In a letter addressed to ministries and agencies, CSC Chairman Dr. Essam Al-Rubaian stated, "if the second party obtains a new educational qualification, changes the job title, relocates or alters the nature of work, a new contract must be signed with the employer reflecting the change in the legal status." He emphasized the importance of taking all the necessary administrative and automated measures within the integrated systems to enforce the provisions of the two aforementioned resolutions, in line with the general rules governing employment relationships for all other categories and groups.
Regarding the mechanism for implementing changes to the legal status of the concerned employee and the amendment of the comprehensive monthly bonus clauses within the integrated systems, Al-Rubaian clarified that the monthly bonus includes the basic salary, social allowance, children's allowance (if any), cost of living allowance, financial support up to a maximum of KD50, monthly increase up to a maximum of KD50, special bonus for those appointed to the general cadre, job-related bonus considered part of the salary, and a screen allowance if applicable.
He explained that variable allowances. such as shift, food, night shift, distance, remote area, location, infection, danger, pollution and noise allowances. are excluded from the comprehensive monthly bonus. He confirmed that amending the comprehensive monthly bonus in the integrated systems does not require the signing of new contracts, but only an update within the system itself.
On the subject of periodic bonuses and job-level promotions, Al-Rubaian announced the completion of the legislation system, financial decisions and special increase decision screens within the integrated system. He stressed the necessity of ensuring that all requests for job-level promotions or financial benefits that result in an increase to the comprehensive monthly bonus for those whose nationality was revoked as per articles Five and Eight must be processed automatically in the integrated systems through the Legislation System screen.
Each request must be accompanied by the necessary supporting documents and information. In cases involving job-level promotions, the request must first be reviewed by the team formed within the relevant government entity, which must confirm eligibility for the promotion. Requests for financial benefits must specify the category to which the increase applies, in addition to the monthly bonus, and must finally be approved through a decision of the Personnel Affairs Committee of the entity's employment affairs supervisors.
Al-Rubaian also cited the preamble to the circular issued on July 3, which stipulates that contracts with those whose nationality was revoked under Article Eight shall be valid for two years, starting from the day following the revocation, instead of one year. He also mentioned the decision issued on July 31, stating that contracts with those whose nationality was revoked as per Article Five shall be valid for one year from the day following the revocation, and renewed directly by the government entity without referring to the CSC.
