Kuwait Banking Association clarifies policy on end-of-service leave days

KUWAIT CITY, Jan 12: The legal opinion of Kuwait Banking Association (KBA) on calculating an employee’s number of leave days at the end of service does not consider Friday and Saturday as holidays, while confirming the validity of the current practice in which Friday is regarded as a holiday and Saturday as rest day, reports Al-Rai daily quoting reliable sources from the association.

Sources pointed out the difference in the two cases shows that with the current application supported by banks, one month (30 days) is divided into six days of work per week so the calculated balance is distributed to five weeks.

On the other hand, if Friday and Saturday are calculated as holidays, one week consists of five working days so the balance will be calculated on the basis of six weeks, not five.

This will increase the leave balance of the employee by one week when his work days are calculated during the settlement of his indemnity. Banks have argued that this is a not legal right for the employee.

Asked if the banks have specified allocations in line with legal developments in view of the implementation of the Civil Service Law, sources revealed the majority of banks have yet to take such a step in the midst of demands which may lead to court or legal proceedings.
