If my company opposes my transfer then what should I do?

This is my second company in Kuwait. My contract started on 07/04/2019 ending on 7/04/2020. So, my question is whether I can take transfer now as I am getting better pay opportunity from another company. Can my present company oppose my transfer? If they oppose, then what should I do?

Answer: As you are currently with your second company, we take it that you were hired locally. If our assumption is correct, then you are entitled to ask for transfer after working with the current company for one year. Indeed if you are a university graduate you could have asked for a transfer at any point in time after joining the current company.

On the other hand if you are not a graduate then you have just fulfilled the requirement of the law which obliged you to have worked one year for the company before asking for a release.

The company you are working for now has no choice but to grant you a release but if they say ‘no’ then our advice to you is to file a case at the Ministry of Social Affairs and Labour through the Labour Department in your area and you will be given a favorable hearing.
