KUWAIT CITY, March 9: The Misdemeanor Section in the Court of Appeals upheld the ruling of the First Instance Court, which acquitted a citizen of breach of trust based on the complaint filed by her supposed friend who accused her of embezzling the funds of a financial association, reports Al-Anba daily. The complainant told the competent authorities that she is the manager of a financial association whose members are her friends, disclosing that each of them agreed to pay a certain amount every month until each member receives the total amount pooled every month.

However, when the accused received the money during her turn – a total of KD12,600 – she stopped paying the agreed amount monthly. The Public Prosecution questioned the accused based on the pieces of evidence presented by the complainant, including the payment schedule signed by the participants, but she denied membership to the association and that she does not know the complainant. Commenting on the ruling, lawyer of the accused, Attorney Hadeel Al-Anazi, explained that the breach of trust charge should include criminal intent and proof that the act was committed concerning a movable property owned by others, while the money was delivered to the offender as a matter of trust.
