KUWAIT CITY, June 11: The Administrative Section in the Court of Appeals reversed the decision of the Public Authority for Disabled Affairs (PADA) to reject the application of a citizen to become the guardian of his mentally disabled brother. Consequently, the court mandated the appointment of the citizen as the guardian of his brother, replacing their mother. Attorney Mohammad Al-Sayegh filed the lawsuit on behalf of his client, requesting authorization for his client to deal with PADA. He explained this move is aimed at removing the mother -- the first defendant -- from the responsibility of taking care of her son and then appointing his client as the guardian for the benefit and well-being of the son with mental disability. Case files indicate that the plaintiff’s brother -- the second defendant -- has a severe and permanent mental disability, and their mother was initially assigned as his caregiver. She later requested PADA to relieve her of this duty, citing illness and old age, but her petition was rejected. The plaintiff asserted that he is the actual caregiver of his brother, who is living with him. He requested official guardianship to be able to protect and manage his brother’s affairs
