Varsity ordered to pay KD1,500 comp

KUWAIT CITY, Sept 28: The Court of Appeals overturned the decision issued by a private university to expel a student from the university during the second semester after failing her in a scientific subject. The court obligated the university to pay compensation worth KD 1,500 to her, affirming that the seized papers and tools were not considered evidence based on fraud.

The details of the incident are summarized in what was presented by the student’s legal counsel Lawyer Khaled Hussein Al-Sawai, who said his client was surprised by the accusation of cheating and the use of inappropriate words by one of the female administrative employees.

After that incident, a decision was issued to fail her in that subject and dismiss her from the university during the second semester. The student appealed the university’s decision but to no avail, stating that the decision was not based on a valid reason and was not justified by reality and the law, but rather it was an abuse of power because the cheating incident had no basis in truth, no papers or tools were seized from her, and no records from surveillance cameras were produced. Lawyer Al-Sawai said the invigilator, when questioned, had testified that the cheating incident was not true, and denied what was attributed to his client. In the merits of its ruling, the court explained that the decision taken by the university was not based on any act of fraud and had no basis in truth, as no papers or tools were seized, and the records of the surveillance cameras were not produced.
