KUWAIT CITY, Oct 5: The Criminal Court acquitted two individuals of charges related to the possession of narcotics and intoxicants with intent to use, as well as charges of resisting security personnel. Lawyer Abdullah Al-Alanda argued that the arrest, search, and seizure procedures were invalid due to the absence of flagrante delicto. He stated that the defendants were not caught in the act and that the case documents were based solely on suspicion and lacked any concrete evidence.
Lawyer Al-Alanda said the arrest and seizure were carried out without a warrant from the Public Prosecution, rendering all subsequent procedures legally void. The court affirmed that personal freedom cannot be violated except in cases clearly defined by law. It emphasized that a police officer observing someone in an abnormal or unbalanced state does not justify arresting or searching that person.
