CAPT expands tender ban list

KUWAIT CITY, Oct 5: The number of companies banned from participating in tenders increased to 10 after the Central Agency for Public Tenders (CAPT) decided to remove one of them from the register and permanently ban it from participating, say reliable sources.

Sources said this decision is based on Paragraph C of Clause One of Article 85 of Public Tenders Law No. 49/2016. Sources confirmed that the decision is a continuation of the agency’s approach to apply the principle of reward and punishment, and its commitment to strictly implement the regulations and laws governing the tendering process.

Article 85 of the law stipulates a number of penalties that the agency could impose on contractors, suppliers or service providers, including warnings, downgrading, deletion from the register, suspension from participation for a period not exceeding five years, and permanent deletion from the register.

The same article affirms that these penalties do not prejudice the contractual rights of the relevant party under the terms of the contract. It also clarifies that the procedures include summoning the contractor or supplier through a registered letter, either by a decision of the agency or upon the request of the contracting party. The penalty is imposed after summoning the concerned party, hearing their statements, and enabling them to defend themselves.

The article also authorizes the agency to issue the decision in absentia if the contractor fails to appear after being formally summoned. The contractor or supplier against whom a penalty decision is issued has the right to appeal to the Grievance Committee within 30 days from the date of the decision, in accordance with the procedures specified in the executive regulations.
