KUWAIT CITY, Dec 20: The Court of Appeals cancelled the verdict issued by the Court of First Instance which obliged a businessman to pay Lebanese Pound 100 million to a real-estate trader.

According to the case filed by the real estate trader against the businessman, the two parties had agreement for the sale of two real estate properties in Lebanon valued at Lebanese Pound 100 million(KD 20,000) subject to signing the contract in Lebanon and making the payment in Kuwait. The real-estate trader said the businessman delayed in paying the agreed amount. The Court of First Instance had annulled the agreement and considered it as never existed.

The defense counsel Lawyer Hashim Al Refai presented conclusive evidence to prove the true position of his client. He said the trader acknowledged within the terms of the contract the receipt of the amount in dispute at the time of contract signing and he cleared his client from the amount. He added that the condition of making the payment in Kuwait is just talk without any basis or proof
