Tenant ordered to vacate shop, pay remaining rent – ‘Pay ex-wife alimony’ Woman wins divorce

KUWAIT CITY, Sept 28: The Court of First Instance presided over by Judge Khaled Al-Rukaibi ordered a tenant to vacate a shop he is renting from the owner and pay the latter KD 2,500 for using the premises due to non-payment of the agreed rent amount. Lawyer Mohammad Khalil Al- Qattan filed the case on behalf of the leaser based on Article 1 of Law No. 39/1990 and Articles 10 and 20/1 of Law No. 35/1978 regarding renting real estate, stressing that the rents should be paid when they are due. He affirmed that the tenant, when he did not pay the agreed rent when due, had violated the provisions of the contract.

Meanwhile, the Family Court ordered a Kuwaiti citizen to divorce his wife due to the harms he caused her, and give her entire rights following the divorce. Lawyer Zaid Al-Khabbaz had filed the lawsuit on the behalf of the wife, after her husband kicked her out along with her daughter. He presented some WhatsApp messages which proved that the husband kicked the wife out of the house many times in the past. Lawyer Al-Khabbaz revealed that the husband also did not pay for the expenses of the family.

For immoral reason: The Criminal Court adjourned until Oct 18, 2017 the hearing on a case filed against a former MP accused of tricking a woman to sleep with him. The court decided Wednesday to conduct a closed session during which the accused MP was brought in but he denied the charges. The victim’s lawyer demanded for civil temporary compensation of KD 5,001 for damages caused to his client. The woman said she approached the accused in June 2015 to help her get a job considering he was a public figure as he was a member of Parliament then. She added that he got her number and he started texting her love messages. The Public Prosecution had earlier referred the complaint filed by the female citizen to the Criminal Court, accusing the former MP of tricking her into sleeping with him after promising her several times that he will marry her only to refuse to officially document their customary marriage later.

: The Court of First Instance ordered a Kuwaiti citizen to pay alimony of KD 1,800 along with KD 600 as alimony for the waiting period to his ex-wife. The counsel to the ex-wife Lawyer Mohammad Khalil Al-Qattan revealed that his client was divorced without being consulted. He stressed that the alimony amount, as per Article 165 of the Personal Status Law, is estimated based on the monthly expenses and the financial conditions at the time of deserving the alimony. Lawyer Al-Qattan explained that estimating the alimony amount up to the judge but based on the condition that it must not exceed the expenses of one year. He based his defense on Article 161, which is related to the alimony for the waiting period after the divorce, and on Article 163, which states that the alimony is considered as a loan deserved by the divorced wife.

Hearing Nov 6: The Court of Misdemeanors set Nov 6, 2017, to listen to the defence arguments in the so-called ‘Al-Fintas Group’, reports Al-Rai daily. The Public Prosecution is accusing the suspects Khalifa Al-Ali, Athbi Al-Fahad, Abdulmohsen Al- Ateeqi, Ahmad Dawood Al-Sabah, Falah Al-Hajraf and Hamad Al- Haroun of using sophisticated equipment to record the telephone conversations of the National Assembly Speaker Marzouk Al- Ghanim between November 2014 and May 2015 illegally and posting on YouTube. The Prosecutor is accusing the suspects of tampering with the conversations to tarnish the reputation of the Speaker. The Prosecution pointed out the defendants deliberately abused and defamed Al-Ghanim by taking two pictures without his knowledge or satisfaction. One of the pictures was edited and he was shown sporting a beard and it was posted on YouTube accompanied by his tempered conversations.
