KUWAIT CITY, April 20: The Criminal Court dismissed the petition filed by a Kuwaiti citizen against Public Prosecution’s decision to withhold a case he filed against his wife, accusing her of committing adultery with a married citizen. During investigations, the plaintiff explained that his sister saw his wife with her friend going to a hotel apartment building in Fintas area, adding that he also found a video in which his wife was indulging in copulation with her friend.

Lawyer Nasser Al-Bashir represented the citizen who was accused of committing adultery with the plaintiff’s wife. During the court session, Lawyer Al-Bashir explained that his client’s wife had signed a concession where she accepted to continue marital life with her husband and said she will refrain from suing him as the main accused in the adultery crime. This concession requires refrainment from suing the second partner in the crime as per article 104/4 of the Procedures Act added to law No. 6/1996 amended by law No. 74/2001.
