Panel likely to reject appeals of Bangladeshi MP & top officials

KUWAIT CITY, July 27: On Sunday, July 25, the Cassation Prosecution Panel finished preparing its viewpoint regarding the case involving the Bangladeshi MP. The viewpoint includes rejecting the appeals submitted by the defendants and the Public Prosecution in the case. A session will be set with the Court of Cassation in the coming days in order to consider the matter. It is noteworthy that the defendants in the case are officials from the Ministry of Interior and the Public Authority for Manpower, as well as a former MP.

The Criminal Court of Appeals had sentenced the former Assistant Undersecretary for Citizenship and Passport Affairs Sheikh Mazen Al-Jarrah, a former official of PAM Hassan Al-Khidr, and the former MP Salah Khurshid to seven-year imprisonment with hard labor after they were convicted of bribery and abuse of power. The court decided to uphold the ruling of the Court of First Instance which sentenced former candidate of the Fourth Consitutuency Nawaf Al-Mutairi to four-year imprisonment, and an employee of the Bangladeshi MP’s company Muhammad Rashidoun to three-year imprisonment with hard labor.

The court acquitted the former MP Saadoun Hammad. In the rationale for its ruling, the court stated that all the crimes attributed to the first accused, which it convicted him of, were organized by a single criminal circle with several acts that complement each other, and together formed the criminal unit that was defined by the law. This requires severe punishment due to which the law will not be lenient on the matter because the accused committed serious crimes that infringe human rights and jeopardize national security.
