Fatwa, Legislation Department sole institution to handle cases

KUWAIT CITY, Sept 5: The State Ministry for Housing and Services Affairs and its affiliates incurred losses amounting to KD 11 million due to lawsuits in the last 10 years, reports Al-Qabas daily quoting State Minister for Housing and Services Affairs Jinan Boushehri in her response to the question raised by Deputy Speaker of the Parliament Essa Al-Kandari.In his question, Al-Kandari pointed out Kuwait Ports Authority (KPA) lost more than KD 8 million, while the Public Authority for Housing Welfare (PAHW) recorded KD 2 million losses due to rulings issued against them.Boushehri revealed the number of cases concerning public institutions including her ministry reached 4,233 within the abovementioned period; in addition to 960 for PAHW; 3,582 for Kuwait Credit Bank; 77 for services affairs (formerly transport authority); 627 for Kuwait Ports Authority (KPA) and 190 for the Directorate General of Civil Aviation (DGCA). She added these institutions won a total of 1,018 cases within the same period.She affirmed studies aimed at determining sources of disputes or grievances were conducted to resolve the issues and identity relevant departments and committees engaged in administration, technical, legal and financial aspects of the cases. “In case the ruling is against the institution, the reasons for such ruling are studied to determine if it is in line with the law and then the concerned authority submits a petition to the higher court. Whenever the final ruling is against the institution, the details of the case are reviewed to determine errors and then the necessary measures and decisions are taken to ensure that mistakes, if any, are not repeated,” the minister concluded. It is worth mentioning that the Fatwa and Legislation Department is the sole institution which handles cases related to ministries and State institutions.
