KUWAIT CITY, Oct 13: The Court of Cassation presided over by Judge Fouad Al-Zuwaid obliged undersecretary of the Ministry of Finance to repay a Kuwaiti citizen two million nine hundred thousand dinars which the ministry had collected from him unlawfully, given that his building was not on an undeveloped land, reports Aljarida daily.

According to the case file, the court rejected the appeal submitted by the Ministry of Finance requesting rejection of the citizen’s claim on the basis of its eligibility to collect fees in exchange for the ministry’s services on an undeveloped land, which is in accordance with Law No. 8/2008.

However, the Court of Cassation affirmed that the state’s entitlement to these fees is linked to the availability of infrastructure and the delivery of electricity in the areas that deserve fees, and that the land owned by the citizen is not among those areas
