Court finds Kuwaiti woman not guilty of ‘drunk driving’ – Pledge frees expat

KUWAIT CITY, Dec 10: The Misdemeanor Circuit of the Court of First Instance acquitted a Kuwaiti woman who was accused of drunken driving in a reckless manner that exposed her life and the lives of other road users to danger. According to the case file, an officer reported that he was patrolling an area within Salmiya when he saw the woman drive her car recklessly. When he ordered her to pull over and questioned, he detected the smell of alcohol from her The report issued by the Criminal Investigations Department stated that the suspect’s blood sample had only three percent alcohol content, which meant the suspect was not under the influence of alcohol while she was driving her car. The defense counsel Lawyer Abdullah Al-Alanda stressed that his client had been denying the accusations since the early stage of the investigations, adding that the technical report contradicts the testimony of the arresting officer.

Expat released: The Court of Appeals has set aside the verdict of the Court of First Instance that sentenced an expatriate man to three years in prison with hard labor for allegedly defrauding a Kuwaiti woman by using her card to purchase a mobile phone online via K-Net. The appellate court thereby refrained from pronouncing penalty against the suspect but obligated him to sign an undertaking to be of good moral conduct. The case file indicates the suspect obtained details of the plaintiff with which he did the transaction online without the consent of the rightful owner. Defense Lawyer En’am Haider said her client did not benefit from the card, because he paid the value of the sum spent online to make the plaintiff withdraw the case. She stressed her client was a first-time offender, and pleaded with the court to tamper justice with mercy by refraining from pronouncing a penalty.

Case dismissed: The Family Court dismissed a lawsuit filed by a woman who demanded her right to oversee the funds allocated to her daughter by the Public Authority for Disabled Affairs (PADA). According to the case file, the woman had filed the case to dispute the authority of her divorced husband (the father) over her daughter, recommending that the funds allocated to her daughter, who is under her custody, should also be under her control. She insisted that her exhusband is not taking care of his daughter and not spending on her. Representing the father was Lawyer Mariam Al-Bahra, who affirmed during the court session that the authority of the father on his daughter is mandatory and that the plaintiff did not present any substantial evidence to back her allegations.

Officer acquitted: The Criminal Court acquitted a Kuwaiti military officer and his friend who were accused of possessing methamphetamine for personal use and driving under the infl uence of drugs. According to the case file, securitymen, while patrolling Fintas, demanded the second suspect to pull over his vehicle which he was driving in violation of the traffic regulations. They discovered that the driver did not have a driving license, and that he and his passenger – the military officer – were in a disoriented state. Securitymen searched them and found methamphetamine in the pockets of the driver who admitted that the drugs were intended for his personal use. During the court session, the defense counsel of the first suspect Lawyer Khawlah Al-Hassawi stressed on the invalidation of the arrest procedures and the subsequent measures due to unavailability of necessary legal justifications to conduct the arrest and search operation.
