KUWAIT CITY, Oct 16: The Court of Appeals overturned the decision of a lower court that sentenced an expatriate lady to one month in prison followed by deportation, and acquitted her of consuming alcohol in public, despite the legal period of one month for appealing the verdict expired a year ago. The Public Prosecution charged the foreigner of consuming alcohol in public at Salhiya area. In her defense, Attorney Dr Hana’a Bu Jarwa provided substantial evidence to support submission that her client qualified to appeal the verdict even though the legal period for appealing the verdict had expired. He explained the former attorney of her client did not pursue his duties effectively on the case, and failed to notify the client on the decision issued in absentia against her.

‘Man not guilty’: The Criminal Court has acquitted a citizen of offending the entity of HH the Amir and burning his citizenship document. The court referred the citizen to the Psychiatric Hospital. Case files indicate the citizen recorded the incident and posted the video clip on social networking sites. Security officers from the Interior Ministry arrested the citizen, who is unemployed, in his house in Al-Qusour immediately after they received information on the offensive video clip. They then referred him to the Public Prosecution.

Ruling Nov 13: The Misdemeanor Court of Appeals has set Nov 13 to deliver judgment in the case filed by State Security Department against a female activist Rana Al-Sa’adoun over alleged re-tweeting of Musallam Al-Barrack’s speech titled “Enough of Frivolity”. It is worthy of note that the court suspended execution of a jail term against the activist with KD 500 bail bond. Security operatives arrested the woman as she returned from a trip overseas to enforce the three-year jail term for re-tweeting “Enough of Frivolity” speech.

Hearing today: The Constitutional Court chaired by Judge Yousef Al-Mutawa will Monday continue hearing in the new lawsuit filed against DNA Law. Lawyer Mohammad Abdullah Al-Enezi filed the first petition with the Constitutional Court against DNA Law, urging the court to declare the law null, void and illegal. One of the main reasons for the lawsuit is that the law stipulates jail term for parents whose children refuse to participate in the exercise.

Jail extended: The Sentence Renewal Judge extended for 15 days the detention of a Flight Lieutenant attached to Kuwaiti Army and a pilot accused of offending the Amiri entity. The accused denied the charges and maintained it was not their intention to be rude to the Amiri entity through photos disseminated via their mobile phones without their knowledge. In their defense, attorneys of the accused appealed to the court for their release on guarantee, adding there are no justifications for continuing precautionary detention.

Dud cheques case: The Misdemeanor Court acquitted a suspect of issuing two dud cheques worth KD 450,000 after the General Department of Criminal Evidences presented a report proving his signature had been forged. The case file indicated the Public Prosecution Department charged the suspect for allegedly signing two dud cheques that added up to KD 450,000 to prevent the supposed beneficiary from receiving it at bank.
