Compensation for Kuwaiti ordered in mistaken arrest

‘Ethical, moral, financial damages’

KUWAIT CITY, Feb 9: The Administration Court ordered Ministry of Interior to pay temporary civil compensation worth KD 5,001 to a Kuwaiti citizen who sustained ethical, moral and financial damages after he was mistakenly arrested.

Representing the citizen was Lawyer Nasser Al-Sarheed who explained that his client was arrested at Salmi border checkpoint while leaving the country with his family.

He was referred to Jleeb Al-Shuyoukh Police Station, and then to Shuwaikh Industrial Area Police Station. His client underwent terrible ordeal with the police due to an alleged travel ban imposed on him because of several criminal and financial cases filed against him. He was released after he vowed to present himself at the authority when summoned.

The client attempted to exit again via the same border checkpoint and he was arrested again. He spent 22 days in prison. However, his fingerprint report indicated that he was a victim of identity theft, and the authorities realized that a Palestinian man had stolen his identity due to similarity in their names.
