Cheat company pays back dues

KUWAIT CITY, Jan 6: The Court of Appeals overturned the ruling of a lower court, which dismissed a citizen’s lawsuit against a real estate company for fraud. The higher court then instructed the company to cancel a chalet sale contract and refund KD 120,000 for violating the terms of the contract.

According to the citizen’s lawyer — Attorney Ali Al-Ali, his client concluded a contract with the company for the purchase of a chalet in Khairan at KD 120,000 which was paid in full upon signing of the contract and a receipt was issued. The plaintiff fulfilled all his obligations and fully paid the chalet, but the company did not register the chalet under the name of the citizen. It was found later that the company does not own the chalet.
