Woman Wins Legal Battle Over Residential Plot Title Deed in Kuwait

KUWAIT CITY, May 31: The Court of Appeals upheld the ruling of a lower court in favor of a female citizen, granting her the right to obtain the title deed for a residential plot. Attorney Ali Al-Ali, lawyer for the plaintiff, filed the case against the husband of his client and several government entities. The Court of First Instance previously ruled in favor of the plaintiff, granting her the right to obtain the title deed for the property allocated to her and her husband. It also granted her the authority to take legal and administrative steps at the Public Authority for Housing Welfare (PAHW), Kuwait Credit Bank, Ministry of Justice and Real Estate Registration Department without the consent or signature of her husband.

This decision was taken after the court determined that the husband refused to complete the procedures for obtaining the title deed despite attempts of the plaintiff to reach an amicable settlement. Al-Ali affirmed in court that his client is the co-owner of the residential plot, as per the allocation certificate issued by the PAHW. He argued that the husband's refusal of the husband to sign prevented his client from obtaining her legal right to the title deed, hence, the need for legal action to protect her housing rights. He added that the ruling established the principle of protecting the rights of beneficiaries of government housing and preventing abuse of that right, especially in matters related to ownership procedures and administrative action concerning housing plots.
