KUWAIT CITY, June 20: The Court of Cassation upheld the ruling of the Court of Appeals, which refrained from sentencing a married man convicted of harassing a woman and pursuing her in his vehicle in a manner that endangered other road users, reports Al-Seyassah daily.
According to the case file, the woman was on her way to pick up her son from school when the defendant approached her and made advances, touching her lower back without her consent. When she left in her vehicle, the defendant followed her, attempting to stop her and obtain her phone number. He drove recklessly, mounting the sidewalk and driving against traffic flow, causing traffic disruption and an accident that caused property damage.
The Public Prosecution charged the defendant with molestation and committing an indecent act in public, in addition to several traffic violations, including reckless driving, endangering others, causing a traffic accident, obstructing traffic, driving with only one license plate, driving on the sidewalk, and driving against the flow of traffic.
The Court of First Instance sentenced the defendant to five years in prison with hard labor for the rape and indecent act charges, in addition to fining him for the traffic violations and suspending his driving license for one year, which will start after serving his prison sentence. However, the Court of Appeals amended the ruling and suspended the implementation of the sentence for the first two charges in exchange for KD2,000 fine and a pledge to maintain good conduct for two years.
