Unable to Access MS Teams for 2 Months, Student Wins Case Against Kuwait's Education Ministry and Is Promoted to Eighth Grade

KUWAIT CITY, Aug 10: The Administrative Circuit of Kuwait’s Supreme Court has overturned the Ministry of Education’s decision to fail a seventh-grade female student for unexcused absences and ordered that she be considered successful and promoted to the eighth grade.

The court also cancelled the ministry’s assessment of the student’s academic performance as “weak”, along with all resulting consequences.

Lawyer Badr Muhammad Al-Dalk said his client’s daughter was studying at a girls’ middle school in the Al-Ahmadi Educational District during the second semester of the 2025/2026 academic year.

Due to regional circumstances at the time, the Ministry of Education had introduced a remote learning system. However, the student was unable to access the Microsoft Teams educational platform for nearly two months because of technical difficulties, with the platform only becoming operational for her in April.

Al-Dalk told the court that the student’s inability to access the platform was caused by circumstances beyond her control. Once she was able to log in, she immediately resumed her studies and fulfilled her academic obligations.

He also explained that the exceptional circumstances prevailing during the period made it difficult for the student and her family to report and resolve the technical problem at the time.

Based on the case, the court cancelled the failure decision and its associated academic consequences, effectively restoring the student’s status as having successfully completed the seventh grade and allowing her to advance to the eighth grade.
