KUWAIT CITY, Oct 1: The Misdemeanor Court acquitted a female teacher of charges of assaulting a colleague following a dispute over workers entering the school to move boxes and bags of books, reports Al- Seyassah daily. The incident stemmed from an accusation that the teacher assaulted her colleague outside their workplace. The complainant alleged that the defendant struck and pushed her, causing her to fall and sustain a shoulder injury, as documented in a medical report. Lawyer Mohammad Baqer represented the defendant, arguing that the charge was unfounded and that the alleged incident had not been proven against his client.

The court heard testimony from several witnesses who confirmed that they had observed a verbal altercation between the parties but stated that none of them had seen the defendant physically assault the complainant. Furthermore, police investigations found no evidence to substantiate the complainant’s allegation of physical assault. The court affirmed that the case file lacked conclusive evidence proving that the defendant had committed the alleged act. It noted that her denial of the charge was consistent with the witness testimony and investigation findings, thereby negating the elements of the alleged assault. Consequently, the court acquitted the defendant of the charges pursuant to Article 172 of the Code of Criminal Procedure. Regarding the civil claim, the court ruled that it lacked jurisdiction to hear the matter and ordered its transfer to the competent court, while reserving its decision on legal costs.
