KUWAIT CITY, May 14: The Administrative First Instance Court has overturned a decision issued by the Ministry of Electricity, Water, and Renewable Energy that penalized an employee by deducting seven days’ pay, along with all associated consequences. The court affirmed that administrative investigations and their findings do not constitute a final judicial ruling, and that employees have the full right to appeal disciplinary decisions before the Administrative Court if they are flawed or lack a sound legal basis.
According to the case file, the employee was referred to an administrative investigation after being accused of using his personal username to complete a transaction at the Shuwaikh Residential Center, which resulted in the alteration of electricity and water meter data without payment of outstanding dues.
The ministry penalized him by deducting seven days’ pay and referred the matter to the Public Prosecution. Lawyer Omar Al-Hammadi filed the case on behalf of the employee, arguing that the disciplinary decision was invalid due to a lack of conclusive evidence. He insisted that there were fundamental deficiencies in the administrative investigation and that his client was not present at the location of the incident when it occurred. The court, in its reasoning, highlighted that the case file lacked conclusive evidence proving that the employee had committed the violation, and that the administrative investigation did not fulfill its essential requirements and failed to address basic questions related to the incident.
