‘Punish man faking as doctor’ – Top officer reinstated

KUWAIT CITY, Jan 31: The Court of Appeals chaired by Judge Ashraf Hejazi upheld the verdict of the Court of First Instance which cancelled the decision to retire the senior assistant transaction executor at the General Traffic Department, and ordered his retention in office. On behalf of the plaintiff, Lawyer Ali Al-Ali filed a case over the sudden decision to retire his client. He said the decision violated the constitution, as it was issued in a surprising manner without prior notice. He argued the department did not have the prerogative to take such a decision, considering he has many years of experience and possesses skill needed to run the office. The court premised the decision on the fact that the plaintiff has not completed the mandatory 30 years period in service.

‘Doctor’ in trouble: The Public Prosecution has referred the case of a fake doctor to the Criminal Court, reports Al-Jarida daily. The suspect is charged with impersonating a doctor at the Amiri Hospital and practicing the trade without license. The Prosecution is seeking the stiffest punishment on the Kuwaiti suspect.

Hearing adjourned: The Court of Appeals adjourned until Feb 7 the hearing on a petition filed by those accused of involvement in the Khairan Pearl chalet public brawl which led to the death of one. The court sentenced four of the accused to 10 years in prison with hard labor while three were sentenced to five years of prison with hard labor. It also ordered immediate execution of both sentences. Case files indicate the Operations Unit in the Ministry of Interior received a report about the fight between nine people who exchanged blows and stabbing. Ambulances and patrol vehicles were dispatched to the location immediately. The injured were then taken to Adan Hospital where one of them died.

Woman wins case: The Court of Appeals presided over by Judge Ayman Al-Ruweishid overturned the lower court’s verdict that obliged a Kuwaiti businesswoman to pay KD 17,000 to a company that leased a business premises to her in Al-Qurain Market, Abu Fateera area. The court ordered the woman to pay the previously declared sum of KD 2,500 to the company for damages. Representing the businesswoman, Lawyer Ali Al-Ali told the court that his client leased the premises on commercial basis and not vocational, and after completing refurnishing of the premises in order to start business, the concerned government bodies declined to issue her license, indicating his client did not benefit from the premises. The company filed a case to oblige the businesswoman to pay KD 325 monthly rent they agreed upon until the date she vacates the premises but Lawyer Al-Ali protested, as it article 561 of civil law. The law annuls compensation right as long as the property has been not been used.
