KUWAIT CITY, Oct 20: The Misdemeanor Appeals Court has upheld a first-instance ruling acquitting a security officer working in the Criminal Security Sector of the charge of carrying a firearm in a prohibited place after a pistol and five live rounds were found inside his suitcase as he prepared to travel through Kuwait International Airport.

The court found that the weapon was official property entrusted to the officer as part of his duties and that its presence in the suitcase resulted from an unintentional oversight. No evidence established that he had attempted to conceal the weapon or circumvent airport inspection procedures.

Lawyer Fahd Al-Shammari, who defended the officer, argued that the elements of the alleged crime and criminal intent were absent. He stressed that the pistol belonged to the authorities and that the officer had not carried it for personal purposes.

The defence also maintained that the officer’s responsibility for the weapon arose from the nature of his job, including its possession and safekeeping as official property.

In upholding the acquittal, the court took into account the circumstances surrounding the weapon’s presence in the suitcase and the absence of evidence indicating deliberate wrongdoing.
