Office must compensate sponsor if worker failure

KUWAIT CITY, May 22: The Public Authority for Manpower (PAM) said a Kuwaiti citizen has the right to report any request from the owner of a domestic workers recruitment office to hike the price of recruitment to help implement the law in the face of those who exploit the license in violation of the applicable laws, reports Al-Anba daily quoting a reliable source. The source explained the law obliges the owners of domestic workers’ recruitment offices to guarantee the domestic help works for a minimum of six months, during which he must return the domestic worker to his country and return the money the Kuwaiti paid to the recruitment office, if there is an obstacle that prevents the domestic worker from carrying out the work that has nothing to do with the employer according to Law No. 68/2015.

Moreover, PAM has determined according to the source that in the event the domestic helper leaves work to find employment somewhere else, the employer must file an ‘absconding’ report at one of the government Service Centers of the Ministry of Interior, in addition to visiting the Department for Regulating the Recruitment of Domestic Workers to file a complaint. In case the worker is caught the Kuwaiti has the right to claim compensation. In the event the worker has not completed 6 months from the date of recruitment, the office must compensate the employer with the full amount he paid for the recruitment and the worker’s return travel ticket.
