New law marks major step in combating domestic violence

KUWAIT CITY, March 17: Hawraa Al-Habib, Head of the Child Affairs Center at the Kuwait Lawyers Society (KLS), says the new draft law on protection from domestic violence, which was recently published in the official gazette “Kuwait Al-Youm”, represents a significant and progressive legislative step in enhancing family protection in Kuwaiti society and reducing domestic violence crimes, reports Al-Seyassah daily.

In a press statement, Al-Habib explained that the law is among modern legislation that strengthens the legal protection system for all family members, and provides a clear framework for dealing with domestic violence cases and protecting all family members without exception. The law also helps address many legal issues related to these crimes and reduces malicious reports. The draft law includes several features to enhance protection of victims, and provide effective mechanisms for handling cases, most notably defining domestic violence as any act, omission, or threat by a family member that results in physical, psychological, sexual, or financial harm.

The draft law also mandates the establishment of a national committee for protection from domestic violence, comprising representatives from several relevant government agencies. This committee will be responsible for developing general policies to combat domestic violence, coordinating among concerned parties, and preparing the necessary awareness and training programs. Al-Habib praised the law’s provisions for creating shelters for victims of domestic violence, providing social, psychological, and health care, and establishing a fund to support victims through assistance, treatment, and rehabilitation.

She explained that the law grants victims the right to file a report with the police, the relevant department, or the investigative authority. It also allows for the issuance of a judicial protection order prohibiting the perpetrator from contacting, approaching, or otherwise harassing the victim. Al-Habib emphasized that the new law represents a qualitative leap in legislation related to family protection in Kuwait, as it offers legal guarantees and mechanisms that strengthen family stability and promote a culture of protection and respect within society.
