Municipal panel rejects home inspection clause

KUWAIT CITY, May 20: The Legal and Financial Committee at the Municipal Council, chaired by Fahad Al-Abduljader, discussed nine items on the agenda for its meeting on Wednesday. The committee withheld the item related to the regulations for awnings and public gardens adjacent to private residences, as well as shelved the letter of Al-Ghanim Law Group regarding the complaint of a citizen about the land in Al-Masayel, because the case has been referred to the concerned court.

On the letter of council members Waleed Al-Dagher and others about Article 44 of Kuwait Municipality Law No. 33/2016, the committee recommended against adopting the recommendation of the Legal Department at the Kuwait Municipality on obligating property owners to allow the Municipality inspectors to enter rented residential units to complete inspections as a condition for issuing description certificates.

The committee clarified that this clause violates the legal and constitutional regulations governing the sanctity of residences. It affirmed its commitment to the aforementioned article and articles 78-79 of the Criminal Procedures and Trials Law to protect the interests of citizens from abuse, exploitation and obstruction. Moreover, the committee referred to the executive body the proposal of member Fahad Al-Abduljader to establish an electronic platform for Municipality violations and delays in finalizing the bidding process for event tent sites.

About the question of Al-Dagher on the use of stateowned land for commercial purposes (parking services), the committee recommended intensifying inspection campaigns to strictly implement the law to combat the phenomenon of paid parking services. In response to the question of member Dr. Hassan Kamal regarding electronic advertisements, the committee recommended specifying clear and practical regulations on lighting intensity for licensing electronic advertising screens and defining an applicable mechanism to monitor the intensity and volume of electronic advertisements. It also suggested providing links for licensing advertisements by government entities if necessary.

The committee rejected the appeal filed by the English Education Group against the decision of the council to remove schools from private residential areas, while it retained on its agenda the item concerning the standardization of administrative certificate fees for employees in all government entities. On the other hand, the Reform and Development Committee, chaired by Abdul Latif Al-Duai also held its meeting on the same day. The committee shelved the question of member Sharifa Al-Shalfan regarding the approved road and bridge design manual and the role of the executive branch in traffic planning and studies.
