MoJ regulates ‘contracts’ for persons with revoked nationality

KUWAIT CITY, Aug 27: The Ministry of Justice issued a measure for regulating the procedures for signing and renewing contracts for employees whose citizenship has been revoked, based on directives from the Civil Service Commission (CSC), the Cabinet, and regulations governing the continued entitlement of certain categories of employees to their prescribed financial and employment benefits, reports Al-Seyassah daily.

The measure covers four categories of employees whose citizenship has been revoked: Female employees covered by Article 8 of the Kuwaiti Nationality Law, those covered by Article 5 concerning individuals who provided distinguished service, those covered by Article 5 and its amendments from the 1965 census, as well as individuals who acquired citizenship through dependency and the children of Kuwaiti women covered by Article 5, Paragraph 2.

The ministry set the contract term for female employees in the Article 8 category at two years, with renewal procedures to be completed at least one month before the contract expires. The contracts for the remaining categories are for one year, renewable annually, and must be renewed one month before the contract expires. The ministry required employees covered by this mechanism to visit the Administrative Affairs Department to complete the contracting or renewal procedures within the specified timeframes.

It confirmed that failure to comply with the required procedures may result in the application of prescribed administrative and financial measures, including the precautionary suspension of salary payments until the procedures are completed. Regarding employees whose citizenship has been revoked, the ministry called on those who have not completed the contracting procedures to visit the Administrative Affairs Department’s End-of-Service Section at the Ministries Complex within one month of the issuance of this mechanism.

Those affected by similar decrees or decisions issued in the future must visit the ministry within one month of their issuance. The ministry has organized procedures for changing an employee’s job title, educational qualification, or work location. Employees must visit the Administrative Affairs Department within one month of the decision’s issuance to sign a new contract reflecting their updated employment details.

The measure also includes procedures for extending social security coverage to employees whose citizenship was revoked in GCC countries and who have regained their original citizenship, in accordance with the Public Institution for Social Security Circular No. 5/2025. The Ministry of Justice confirmed that compliance with this measure is a condition for the continued disbursement of financial entitlements and that the measure is effective from the date of its issuance.

The ministry indicated that contracts with the children of Kuwaiti women will be concluded as soon as the contract template is received from the relevant authorities, adding that they will continue to work in accordance with the Cabinet’s circular on the matter.
