Kuwaiti citizen wins right to divorce Jordanian wife

KUWAIT CITY, Oct 23: The Personal Status Division at the Appeals Court revoked a previous verdict and issued another decision granting a Kuwaiti citizen’s request to divorce his Jordanian wife. The court ordered the defendant to payback the dowry as she lost all her legal rights in that aspect, after the Court of First Instance had rejected the case. Plaintiff Attorney Mariam Faisal Al-Bahar attended the trial and implored the court to overturn the verdict of the Court of First Instance to grant his client divorce since the wife traveled with their son to Jordan and stayed for five years, and then refused to execute settlement obliging her to submit to the husband. Lawyer Al-Bahar reaffirmed the testimony of witnesses indicates the degree of emotional and physical damages caused on account of the defendant’s behavior when she left her matrimonial home for five years. She stressed the defendant traveled with their son without the knowledge and the permission of the plaintiff preventing the husband from seeing his son.

Two acquitted: The Misdemeanor Court presided over by Justice Abdullah Al-Babtain acquitted two citizens of beating a motorist on Beirut Street and damaging his vehicle. As stated in the case file, the plaintiff was on Beirut Street when the first defendant driving in a reckless manner tried to pester him. Along with the second defendant, the plaintiff was forced to pull up, and they started beating him. The altercation resulted in a two-car collision in which the plaintiff’s vehicle was damaged. Lawyer of the two defendants Ali Al-Haraz attended the session and argued that investigations lacked proof to substantiate the allegations against his clients. Moreover, the defendants denied all accusations against them, so they were declared innocent.

Freed on bail: Public Prosecution has decided to release former MP Khaled Al-Sultan on bail of KD 2,000, pending hearing of the case filed against him by Judge Muhammad Al-Duaij, who accused Al-Sultan of “offending and casting doubts on the judicial system” in his recent statement concerning the confidentiality of judicial session over the ‘Abdali cell’ case. In his defense, Al-Sultan completely denied the accusations issued against him.
