Kuwaiti acquitted of threatening and blackmailing a Kuwaiti woman

KUWAIT CITY, Sept 29: The Court of Appeals overturned a lower court ruling that had refrained from imposing a penalty on a Kuwaiti citizen and instead acquitted him of charges of threatening and blackmailing a Kuwaiti woman via WhatsApp, reports Al-Seyassah daily
The complainant filed a report with the Public Prosecution accusing the citizen of threatening and blackmailing her via WhatsApp. During the investigation, the defendant denied the charges, asserting that the complaint was malicious and stemmed from his refusal to marry her. Following the appeal of the lower court’s judgment, defense attorney Mohammad Sati Al-Otaibi argued before the court that the accusation was malicious and fabricated, noting that the complaint was filed only after his client had refused to marry her and ended the relationship.
Al-Otaibi also argued that technical evidence was lacking, explaining that the submitted materials consisted merely of screenshots of WhatsApp conversations that had not undergone technical verification. Consequently, their source and authentic attribution to the defendant could not be established. He pointed out that a search of his client’s phone yielded no photos, video clips, or conversations substantiating the accusation, emphasizing that the malicious and fabricated nature of the charge was evident in the case files - a position the court adopted in its ruling.
