KLS explained that some government institutions prevent lawyers from attending disciplinary investigation sessions with their employees, citing the absence of a legal provision requiring or permitting such representation. This justification is incorrect, as the request does not contradict the general principles of jurisprudence or the principles of fair trials, including the principle that “actions are permissible unless explicitly prohibited” and that “a general rule applies unless otherwise specified.” There is no legal provision preventing a lawyer from accompanying an employee during an investigation. Therefore, the general rules guaranteeing the accused’s right to legal representation and oversight of investigation proceedings should apply.
