Kuwait Court Overturns Unjust Salary Deduction, Sends Strong Message to Authorities

KUWAIT CITY, OCT 25: The Court of First Instance annulled the decision of the Director General of the Central Statistics Bureau No. 339/2023, penalizing a female employee by deducting seven days from her salary. The decision was found to be unjustified and unlawful. The ruling followed the pleadings of Attorney Mohammad Al-Ansari, who argued that the administrative decision was invalid as it is tantamount to misuse of authority and the absence of evidence proving the employee’s alleged violation. The court accepted this argument. The court affirmed in its reasoning that the documents lacked any evidence to prove the violation against the plaintiff. Therefore, the deduction decision was issued without any basis in fact or law and must be annulled.

The court decided to annul the contested decision and its consequences, obligating the administrative authority to pay the expenses and an amount of KD200 for actual attorney fees, in accordance with Article 119bis of the Code of Civil Procedure. The court rejected the request for urgent enforcement due to a lack of legal justification. Al-Ansari said the ruling is another victory for the principle of legality and a clear message to administrative authorities regarding the need to adhere to the law and refrain from abusing power. He emphasized that the ruling embodied a well-established principle that disciplinary authority is not absolute and that its use must be within the limits of the law and in the public interest, not a means of harming or retaliating against employees.
