KUWAIT CITY, May 7: The Domestic Violence Section of the Misdemeanor Court of First Instance imposed a fine of KD 2,000 on a woman after convicting her of psychologically abusing her two children and exploiting them in disputes with her ex-husband in an attempt to strip the father’s custody rights. The father was represented by lawyer Abdulmohsen Al- Qattan, who requested temporary compensation for the psychological and moral harm suffered by his client and the children. The defendant had filed repeated complaints against the children’s father, accusing him of neglect, which resulted in the children being drawn into ongoing family disputes that negatively impacted their mental health.
The court based its conviction on investigations conducted by the Criminal Investigation Department, witness testimonies, and a report issued by the Child Protection Office, which confirmed that the children had not been subjected to abuse by their father. The report documented psychological effects resulting from the mother’s conduct, including psychological pressure and exaggeration, which constituted psychological abuse under the Child Protection Law. The court affirmed that the elements of the offense were fully established and proven against the defendant, noting that her denial did not affect the validity of the evidence and circumstantial proof relied upon by the court. Concerning the civil aspect, the court referred the case to the competent civil court for adjudication of the compensation claims, while reserving its decision on expenses.
