KUWAIT CITY, Dec 10: The Court of Appeals upheld a lower court’s ruling to overturn the warning issued by the Technical Appeals Committee of the Medical Liability Authority against a doctor at Al-Sabah Hospital. The court confirmed that the penalty lacked any technical or legal basis and that the doctor had followed the approved medical protocols in his specialty. The case originated from a patient filing a negligence complaint with the Public Prosecution against the senior general practitioner.
After reviewing the Appeals Committee’s report, which had recommended a warning, the court determined that the doctor had adhered to proper medical procedures according to established standards and that his actions did not amount to gross professional negligence warranting liability. The court explained in its reasoning that medical liability is established only in cases of gross professional negligence, and that a doctor is legally required to exercise due care, not to guarantee a cure.
The administrative warning lacked valid grounds and was issued in violation of the law, leading the court to overturn it. Dr. Fawaz Khaled Al-Khatib, the doctor’s attorney, said the ruling provides essential protection for medical practitioners amid a concerning rise in complaints. He warned that the current situation, marked by excessive criminal, administrative, disciplinary, and civil accountability, threatens doctors’ peace of mind. Dr. Al-Khatib stressed the need to balance the emotional well-being of doctors, who serve in a profession dedicated to human life, while ensuring the protection of patient rights.
