Kuwait Court Cancels Jail, Deportation in Telecom Fraud Case

KUWAIT CITY, Nov 15: The Misdemeanor Court of Appeals overturned the prison sentence and deportation order issued by the lower court against the second defendant in the case of forged mobile phone purchase contracts linked to a telecommunications company, acquitting him based on the defense presented by his lawyer, Abdulmohsen Al-Qattan. The court upheld the conviction of the first defendant in the case.

The Public Prosecution had charged both defendants with forging 132 mobile phone purchase contracts from the telecommunications company. The first defendant had recorded the contract details to make them appear as if they were issued by the company’s authorized employee in the victim’s name. The second defendant had submitted these contracts with a forged signature attributed to the victim, making them appear authentic and valid for use.

Investigations revealed that the documents were seemingly suitable for use in concluding illegal purchase transactions, raising suspicions of forgery. Lawyer Abdulmohsen Al-Qattan argued that the appealed judgment was invalid, citing violations of the Code of Criminal Procedure, specifically the failure to notify the defendant or his lawyer of amendments to the charge, in contravention of Articles 132, 133, and 134. He denied any involvement by his client and asserted that there was no conclusive evidence linking him to the forgery. The court acquitted the second defendant due to insufficient evidence, while upholding the conviction of the first defendant, who was found to have recorded false information.
