KUWAIT CITY, Oct 14: The Family Court of Appeal has overturned a lower court ruling that terminated a mother’s custody of her children because she travelled abroad and allegedly failed to comply with visitation orders.
The Court of Appeal dismissed the lawsuit filed by the woman’s ex-husband, allowing custody of the children to remain with their mother.
Lawyer Aseel Al-Saif said the defense team challenged the lower court’s ruling before the Court of Appeal, seeking its annulment and the dismissal of the custody termination case.
She explained that the appellate court found no legal grounds to transfer custody from her client, emphasizing that a mother’s travel abroad alone is insufficient to justify terminating her custody.
According to Al-Saif, such a decision requires evidence that the custodian’s circumstances harm the child’s best interests or violate the legally established conditions governing custody.
The ruling underscores the importance of the child’s best interests in custody disputes and indicates that travel abroad, by itself, does not automatically disqualify a mother from retaining custody.
