KD 2m debt acknowledgements declared null and void

KUWAIT CITY, July 27: The Court of Appeals upheld the ruling of a lower court, which declared two debt acknowledgments for a total value of KD2 million null and void due to the lack of debt evidence, reports Al-Seyassah daily. Attorney Ismail Dashti filed the lawsuit on behalf of his client, requesting a stay of execution of one of the debt acknowledgments deposited in the Judgments Enforcement Department. He asked the court to absolve his client of the KD2 million debt because the acknowledgments were issued without an actual financial transaction.

Dashti pointed out that his client did not receive the amounts stated in the debt acknowledgments and that there is no evidence proving the transfer of the money to the account of the latter. He added that there is no proof of the plaintiff's ability to provide these funds or their source. The lower court previously ruled that the two notarized debt acknowledgments are invalid due to the absence of evidence of debt and the illogical nature of the proposed payment method.
