KUWAIT CITY, Oct 2: The Court of Appeals upheld the verdict issued by the Court of First Instance, which rejected the lawsuit filed by the Minors’ Affairs Authority as the guardian of a minor girl, and demanded the invalidation of a house ownership document and a “gift contract” from the Kuwaiti citizen to his children and wife.

The facts of the case were presented by the Director General of the Public Authority for Minors’ Affairs, in his capacity as the guardian of the deceased citizen’s minor daughter, demanding the invalidation of the homeownership document and the “gift contract” from the deceased man to his children and wife, for violating public order, circumventing the rules of legal inheritance, and considering the contract as if it did not exist, by removing him from the Real Estate Registration and Authentication Department.

During the court session, lawyer Jassim Al-Tuwaitan, representing the family members of the deceased, said the father of his clients gave the property to them when he was alive 17 years ago. He also had a minor daughter under the guardianship of the Minors’ Affairs Authority. During his lifetime, he did not return or amend the gift, which confirms the effectiveness of the gift in favor of his clients. Lawyer Al-Tuwaitan demanded that the ruling of the Court of First Instance to reject the case be upheld.
